General Terms and Conditions (GTC) for sales to consumers

The following General Terms and Conditions apply to all orders placed by private individuals in the online shop of Ms. Caroline Herrmann-Lauenstein “Die Rockmacherin,” Landsberger Straße 3, 86938 Schondorf, hereinafter referred to as “Rockmacherin.” If the customer uses different terms and conditions, these are hereby rejected.

 

§  1 contract conclusion

  1. For all orders placed in the Rockmacherin online shop

    sole contractual partner.
  2. The promotion of goods in the online shop does not constitute a legally binding offer. By ordering an item marked as available in the online shop, the customer submits a binding offer to purchase the respective item. An automatically generated order confirmation when ordering in the online shop does not constitute acceptance of this offer by Rockmacherin. Acceptance by Rockmacherin takes place through a separate declaration or implicitly through the shipment of the ordered item.
  3. If an ordered item is not available or cannot be delivered immediately, the customer will be notified.
    The customer will be notified.


§ 2 right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods.

To exercise your right of withdrawal, you must inform me,

by means of a clear statement (e.g. a letter sent by post or email) of your decision to withdraw from this contract. Please use the following form for this purpose cancellation policy.

To comply with the cancellation period, it is sufficient to send the notification of your exercise of the right of cancellation before the cancellation period expires.

Consequences of revocation

If you revoke this contract, Rockmacherin must refund all payments for the items she has received from you immediately and at the latest within fourteen days from the day on which she received notification of your revocation of this contract. Rockmacherin will use the same means of payment for this refund as you used for the original transaction.

The skirt maker may refuse to refund until she has received the goods back.

You must return the goods immediately and in any case no later than fourteen days from the day on which you notify the skirt maker of your withdrawal from this contract to Frau Caroline Herrmann-Lauenstein, Landsberger Straße 3, 86938 Schondorf, Germany. The deadline is met if you send the goods before the expiry of the fourteen-day period. You are responsible for the shipping costs for returning the goods.

You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for testing their condition, properties, and functionality.

§ 3 Prices and shipping costs

  1. The prices displayed in the online shop apply.
  2. All prices include the applicable statutory value added tax, unless this is shown separately.

 

§ 4 Payment

  1. Payment for the goods is made in advance.
  2.  When paying via PayPal, you pay directly through your PayPal account. After submitting your order, you will be redirected to PayPal, where you will approve the order value. Once the Rockmacherin PayPal account has been notified of your authorization, the order will be shipped, depending on the delivery time specified for the item. Your PayPal account will be charged with the actual invoice amount immediately after authorization, minus any discounts, gift vouchers, etc.

 

§ 5 Discount code conditions

  1. One-time reduction of the purchase price
    When redeeming discount codes, the purchase price for the item(s) purchased using the discount code will be reduced by the amount or percentage specified in the discount code.
  2. Limited validity period
    Discount codes can only be redeemed for orders placed in the online shop of “Die Rockmacherin” (https://shop.dierockmacherin.de/) during the period specified when the discount code was issued. The discount code loses its validity after this period has expired.
  3. No redemption with third-party sellers
    Discount codes can only be redeemed for products from the seller “Die Rockmacherin.” It is not possible to redeem a discount code for items from other sellers.
  4. Once per order
    Only one discount code can be used per order.
  5. Once per customer
    Only one discount code from the respective promotion can be redeemed per customer.
  6. Restrictions on product groups
    Discount codes may be restricted to certain product groups or individual items, or may contain other special product restrictions. The customer will be informed of any such additional product restrictions when the discount code is issued.
  7. No redemption on reduced products
    Discount codes cannot be used for products that are already marked as reduced.
  8. No retroactive application
    Discount codes can only be redeemed before completing the order process. A retroactive reduction of the purchase price is not possible.
  9. Proportional credit
    If a discount code is used for the simultaneous order of different products for which the discount code is valid, the discount code will be credited proportionally to the order, i.e., the purchase price deduction will be made proportionally from the total price of the respective product.

  11. No cash payment
    Discount code credit cannot be paid out in cash and does not accrue interest.
  12. No refunds for returns/cancellations
    Discount codes are non-refundable and cannot be reused if the customer returns goods paid for in whole or in part with the discount code. This also applies if the return is made within the scope of the statutory right of withdrawal.
  13. Transferability
    Discount codes are transferable.
  14. Shipping costs
    Shipping costs and other fees also apply to products from promotions, provided that these would also apply under normal circumstances. Discount codes cannot be applied to shipping costs or other fees.

§ 6 Voucher terms and conditions

  1. Vouchers can be purchased via the Vouchers menu item in the Rockmacherin online shop.
  2. The voucher will be sent to the purchaser by email as a PDF file for self-printing, free of shipping costs. In the case of prepayment, the voucher will be sent after receipt of payment.
  3. The voucher is valid for three years from the end of the calendar year in which it was purchased.
  4. A voucher order can be revoked or canceled within the 14-day cancellation period without giving reasons. The cancellation form must be used for this purpose. If the voucher has already been redeemed in the meantime, revocation/cancellation is no longer possible.
  5. A voucher can only be redeemed in conjunction with a purchase of goods in the Rockmacherin online shop.
    1. If the voucher is less than the purchase price, the missing amount will be displayed after entering the voucher code and can be paid using the usual payment methods (prepayment, PayPal, credit card).
    2. If the voucher is higher than the purchase price, a new voucher will be issued with the remaining value.

§ 7 Warranty and disclaimer

  1. The purchaser’s warranty claims for used goods expire one year after the transfer of risk. This does not apply to the purchaser’s claims for damages.
  2. If the buyer is aware of a defect prior to conclusion of the contract, warranty claims based on this defect are excluded.
  3. Rockmacherin is fully liable for intent and gross negligence in accordance with the statutory provisions. In the event of damage resulting from injury to life, limb, health, the Product Liability Act, or essential contractual obligations, Rockmacherin shall also be liable for any negligence. Essential contractual obligations are those whose fulfillment is essential for the contract to be fulfilled in the first place and on which the customer may rely. There is no liability beyond this.


§ 8 delivery time

  1. The start of the delivery period specified by Rockmacherin is contingent upon the timely and proper fulfillment of the customer’s obligations. The right to invoke the defense of non-performance of the contract is reserved.
  2. If the customer is in default of acceptance or culpably violates other obligations to cooperate, the skirt maker is entitled to demand compensation for the damage incurred in this respect, including any additional expenses. Further claims remain reserved. If the above conditions are met, the risk of accidental loss or accidental deterioration of the purchased item shall pass to the customer at the point in time at which the customer is in default of acceptance or payment.
  3. Further legal claims and rights of the customer due to delay in delivery remain unaffected.

 

§ 9 Place of performance, applicable law, electronic communication, and alternative dispute resolution

  1. The law of the Federal Republic of Germany applies between the parties.
  2. The place of performance for all obligations arising from the aforementioned contractual relationship is the registered office of Rockmacherin.
  3. The customer agrees that contract-related communication may take place in electronic form.
  4. Rockmacherin is not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.
